Terms of Service

Version 2026-10. Effective October 14, 2026. Last updated October 14, 2026.

The short version

This is a summary. The full Terms below are what count.

  • These Terms are an agreement between you and MathTalk, PBC about using Math! Everywhere! and our websites.
  • A parent or legal guardian agrees for the family. Children use the app through a parent's account, with a grown-up's help.
  • The app is free and is still being tested. It may have bugs, lose work and change often.
  • The app sends families to real places. A grown-up should go along, watch for traffic, stay off private property and follow posted rules.
  • Your family owns what it makes. We use what reaches us only to run the app, and for research if you say yes.
  • AI replies can be wrong.
  • MathBuck$ are points, not money, and the app does not award them during the testing round.
  • Our Privacy Policy explains what we collect and how you control it.

1. Who we are and what these Terms cover

These Terms of Service ("Terms") are an agreement between you and MathTalk, PBC ("MathTalk", "we", "us"), a public benefit corporation at 99 Bishop Allen Drive, Cambridge, MA 02139. They cover the Math! Everywhere! app for iPhone and iPad and our websites, matheverywhere.com and math-talk.com (together, "the Service"). They do not cover our older app, Measure! Everything!.

By making an account, or by using the app or the websites, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use Math! Everywhere!

  • Grown-ups. You must be 18 or older to make an account. A parent or legal guardian makes the family account and accepts these Terms for themselves and for their children.
  • Children use the app only through a profile in a parent's account, with a grown-up's help and on a grown-up's device. Children do not get their own login, and they cannot accept these Terms themselves. Children in grades 6 to 8 also use the app through a parent's account.
  • Teachers who already have accounts may use class features with families who choose to connect (Section 10).
  • Website visitors. These Terms also apply when you visit our websites. The websites' forms are for grown-ups; children should not fill them in.
  • United States only. The app and the testing round are for people in the United States.
  • Personal use. The Service is for your family's own, non-commercial use, and for teachers' use with their own class.

3. The testing round

  • Dates. The family testing round runs from October 20, 2026 to January 20, 2027. We send the app through Apple's TestFlight, and Apple's TestFlight terms also apply.
  • It is a test. The app is not finished. It may crash, lose work, or change from week to week, and features may come and go. Test versions stop working after a time that Apple sets; we will send new ones during the round.
  • Your child's journal lives on your device. Journal entries, photos, drawings and recordings are saved on your phone or tablet, not on our servers. If you delete the app or lose the device, they are gone, and we cannot bring them back.
  • Free. The app is free, and there is nothing to buy in it. Taking part in testing is not paid.
  • Feedback. We want to hear what works and what does not. When you send us feedback or ideas, you let us use them to improve the Service without paying you or naming you. Please leave children's faces and names out of screenshots.
  • After the round. We will tell you before the app changes in a big way or stops.

4. Your account

  • Give true information when you sign up, and keep it up to date.
  • Keep your sign-in safe. Tell us right away if you think someone else used your account.
  • You are responsible for what happens in your account, including your children's use of the app.
  • The grown-up who made the family account (the "primary grown-up") can add children and change their profiles. Today each family account has one grown-up; adding another is not open yet.
  • To delete a child's profile or the whole family account during the testing round, or to close your own account, email us (Privacy Policy, Section 18).

5. Staying safe in real places

Math! Everywhere! sends families to real places: towers, missions, trails, community events and partner businesses. The app is a guide for learning together. It is not a supervisor, and it does not check whether a place is safe.

  • Go together. A grown-up should go with children, or watch them closely, for any activity out in the world.
  • Watch for traffic. Do not use the app while crossing a street, walking near traffic, riding a bike or driving. Look up, not at the screen.
  • Respect property and rules. Stay off private property unless you are welcome there. Follow posted signs, opening hours and each place's rules. A place on the map is not an invitation to go in.
  • Places can be wrong. A computer picks most places from public maps. Some may be closed, private, in the wrong spot, or not right for children. Place photos come from other websites, and no person checks each one. If something seems wrong, skip it and tell us.
  • Photos. Take photos of things, not people. Ask before you photograph anyone. Do not photograph papers that show a name or a school.
  • Weather and health. Dress for the weather, bring water, and stop if anyone is tired, hurt or unwell.

6. Using the Service the right way

You agree not to do these things, and to help your children not to:

  • try to get into someone else's account, a child's profile that is not yours, or information that is not yours;
  • interfere with the Service, get around its security, or overload it;
  • copy, scrape or take apart the app, except as the law allows;
  • use the Service to bother, harm, endanger or collect information about anyone;
  • put other people's personal information, like names, faces, addresses or phone numbers, into the app, reports or feedback without their permission;
  • pretend to be MathTalk, a school, a partner business or anyone else;
  • use the Service for business purposes, like reselling MathBuck$ or rewards;
  • use the Service while driving, or in any way that breaks the law.

We may remove content, and suspend or end access, for anything that breaks these rules (Section 15).

7. What your family makes

  • You own it. Journal entries, photos, drawings, voice recordings, answers and everything else your family makes belong to your family.
  • Most of it stays with you. The journal, with its photos, drawings and recordings, stays on your device (Privacy Policy, Section 5).
  • The permission you give us. When something your family makes reaches us or a company that helps us (for example card answers, survey answers, entries you send us, or what your child sends to an AI feature), you give MathTalk permission to store and use it to run, fix and improve the Service, to keep it safe, and, only if research is on, for the research described in the Privacy Policy. This permission is free and non-exclusive, so you can still use your things however you like. It ends when the item is deleted, except for short-lived backup copies and combined results with no names (Privacy Policy, Sections 11 and 16).
  • No marketing without asking. We will not use your child's work, words, face or voice in advertising, on our websites, or in reports or talks without asking you first with a separate form.
  • Removing content. We may remove anything that breaks these Terms or seems unsafe.

8. AI features

  • AI replies can be wrong, incomplete, odd, or not right for a child. No person checks each reply before it is shown.
  • AI replies are learning prompts. They are not safety, medical or professional advice, and they do not replace a teacher's or a parent's judgment.
  • Explore AI replies together with your child, and tell us when something seems off.
  • Do not put personal information into AI features, like full names, faces, addresses or a school's name.
  • Both "Talk to Me!" features, and "Check My Work", are computer programs, not people.
  • The Privacy Policy, Section 7 says which AI companies we use and what each one gets.

9. MathBuck$

  • Points, not money. MathBuck$ are points a child can earn in the app, for example by finishing missions and earning badges. They have no cash value. They cannot be bought, sold, traded, transferred or turned into money, and they are not a gift card or any kind of currency.
  • During the testing round. The version of the app families get in this round does not award MathBuck$, and points cannot be spent anywhere yet.
  • Spending at partner businesses. We plan to let children spend MathBuck$ on small items at local partner businesses, starting in Greater Boston in January 2027. Other places may follow later.
  • Partners make their own rules. Each partner business decides what it offers, how much and when, and can change or stop at any time. Partners are independent businesses, not part of MathTalk. The partner, not MathTalk, is responsible for its items and its place.
  • A grown-up goes along. Spending points means visiting a real business, so a grown-up should be there. We plan for a grown-up to approve each spend in the app before spending opens, and we will update these Terms when it does.
  • We can change the program. We may change how points are earned or spent, change the partner list, or pause or end the program. If it ends, unspent points end too, and nothing is owed for them.

10. Classes and teachers

  • Families choose. Where the app offers it, a parent can connect a child to a class with a code from the teacher, and disconnect at any time. What teachers see is in the Privacy Policy, Section 12.
  • Teachers. If you are a teacher, use class features only to support your own class, follow your school's rules, keep children's information private, and do not copy it out of the app.
  • Schools. These Terms do not set up any arrangement with a school. If a school uses the Service with its students later, a separate written agreement with that school will add rules, and it will control for that school's use where it differs from these Terms.

11. Research

The research study is a separate choice, described in the Privacy Policy, Section 11. Turning research on or off does not change how your child uses the app. If we ever want to share more than summaries with researchers, we will ask you first with a separate form.

12. Other companies' services

  • Apple and Google. The app comes through Apple's TestFlight and runs on Apple devices. Sign in with Apple and Google sign-in are run by Apple and Google under their own terms.
  • Maps and places. Map pictures come from Mapbox, and place information comes partly from Foursquare. Their data is used under their terms, and it may be wrong or out of date. Map data: © Mapbox, © OpenStreetMap contributors. Places data from Foursquare.
  • Photos and links. Some place photos and links come from other websites. We do not control those websites and are not responsible for them.
  • Partner businesses are independent. What you do with them is between you and them.

13. Our app and content

  • MathTalk and the people we license from own the Service: the app, its missions, characters, text, art, sounds and software, and the Math! Everywhere! name and logo.
  • We give you a personal, free, limited permission to use the Service as these Terms allow. You may not copy, sell or change the app, or use our names or logos, without our written permission.
  • Some parts of the app are open-source software that come with their own licenses.

14. Privacy

Our Privacy Policy is part of these Terms. It explains what we collect, why, who gets it, how long we keep it, and how you can see, copy or delete it. If these Terms and the Privacy Policy disagree about personal information, the Privacy Policy wins.

15. Changes, and ending your use

  • Changes to the Service. The app is a test, and it will change. We may add, change, pause or remove features, places and content at any time.
  • Changes to these Terms. If we change these Terms in a way that matters, we will post the new version here with a new date, and tell you in the app or by email before it takes effect. If you keep using the Service after that, the new Terms apply. If you do not agree, stop using the Service and ask us to delete your account. Changes to how we handle children's information follow the Privacy Policy: we ask you again first.
  • You can stop at any time. Email us to delete your children's profiles or your family account, or to close your own account.
  • We can stop your access if you break these Terms, if we need to for safety, security or the law, or if we end the testing round or the Service. Where we can, we will tell you first.
  • What keeps applying. Sections 7 (as limited there), 9, 13, 16, 17, 18 and 20 keep applying after your use ends.

16. Disclaimers

  • The Service is a free learning tool that is still being tested. We provide it "as is" and "as available". To the extent the law allows, we make no promises beyond those in these Terms. That includes promises the law sometimes implies, such as that the Service is fit for a particular purpose, works without errors or interruption, or that places, photos and AI replies are accurate.
  • The Service supports learning. It does not replace a teacher or a parent, and we cannot promise any particular learning result.
  • Some states do not allow some of these disclaimers, so they may not all apply to you.

17. Limits on our responsibility

  • To the extent the law allows, MathTalk is not responsible for indirect losses, such as lost data, lost profits, or special or punitive damages, that come from using or not being able to use the Service.
  • To the extent the law allows, our total responsibility for any claim about the Service is limited to $100.
  • Nothing in these Terms limits responsibility that the law does not allow to be limited, such as for injury or death caused by our negligence, for our gross negligence or intentional wrongdoing, or for fraud, or limits your rights under consumer protection laws, including Massachusetts General Laws chapter 93A.

18. Governing law and disputes

  • Massachusetts law. The laws of Massachusetts govern these Terms, without their rules for choosing another state's law, except where the law where you live gives you protections that cannot be waived.
  • Talk to us first. If you have a problem with the Service, email us at info@mathtalkpbc.com. We will try to solve it within 30 days.
  • Courts. If we cannot solve it, either of us may take the dispute to the state or federal courts in Middlesex County, Massachusetts, or to a small claims court where you live.

19. If you got the app from Apple

  • These Terms are between you and MathTalk, not Apple. MathTalk, not Apple, is responsible for the app and its content.
  • Your permission to use the app covers Apple devices you own or control, as Apple's rules allow.
  • Apple has no duty to support or maintain the app.
  • If the app does not meet a warranty that applies to it, you may tell Apple, and Apple may refund the price you paid, which is nothing. Apple has no other warranty duty for the app.
  • MathTalk, not Apple, handles any claims about the app, including product claims, claims that it breaks a law, and claims that it breaks someone's intellectual property rights.
  • You confirm that you are not in a country under a US government embargo and not on a US government list of restricted parties.
  • You must follow the terms of other services you use with the app.
  • Apple and its subsidiaries may enforce these Terms against you as third-party beneficiaries.

20. General

  • These Terms and the Privacy Policy are the whole agreement between you and MathTalk about the Service.
  • If a court finds that part of these Terms cannot be enforced, the rest still applies.
  • If we do not enforce part of these Terms right away, we can still enforce it later.
  • You may not transfer your rights under these Terms to someone else. We may transfer ours to an organization that takes over the Service, if it agrees to follow these Terms and the Privacy Policy.
